Terms & Conditions — Hermes SMS Messaging Program

These Terms & Conditions (“Terms”) govern your use of the Hermes SMS messaging program (the “Program”) operated by Tyler Hudson (“Operator,” “I,” “me,” or “my”), a sole proprietor, using the telephone number +1 (207) 230-6594. By texting the Program number or continuing to exchange messages with Hermes, you agree to these Terms and the Privacy Policy.

Program summary. Hermes is a personal AI assistant that replies over SMS when you message it. This is not a marketing blast list. You control participation by texting in and by opting out. Message and data rates may apply.

1. The Program

Hermes provides conversational SMS responses to messages you send. Replies are generated with the assistance of automated systems and may be imperfect. The Program is provided for general informational and personal-assistant use. It is not a substitute for professional advice (legal, medical, financial, emergency, or otherwise), and it is not an emergency service. If you need emergency help, contact local emergency services directly.

2. Eligibility

You must be able to form a binding agreement and must use a mobile phone number that you own or are authorized to use. The Program is intended for users with U.S. mobile numbers. If the Operator enables an allowlist, only approved numbers may participate.

3. Opt-in consent for SMS

You opt in to the Program by affirmatively sending an SMS to +1 (207) 230-6594 from your handset (customer-initiated messaging). That first message is your consent to receive Program replies related to your conversation with Hermes.

Consent is not a condition of purchasing any good or service.
Consent is specific to this Program and brand (Tyler Hudson / Hermes SMS).
Consent is not transferred or sold to third parties for their marketing.

4. Message frequency, rates, and support

Frequency: variable. You generally receive replies when you send messages.
Rates: message and data rates may apply based on your carrier plan.
Help: reply HELP or email william.bernard@cadenceworks.tech.
Stop: reply STOP to cancel. After opting out you will not receive further Program messages unless you opt back in (for example by texting the number again or replying START where supported).

5. Acceptable use

You agree not to use the Program to:

Violate law, carrier rules, or Twilio / messaging platform policies;
Harass, threaten, exploit, or abuse any person;
Attempt to probe, disrupt, or gain unauthorized access to systems;
Send malware, spam, or deceptive content through or to the Program;
Use the Program for prohibited SMS categories (including unlawful content, or affiliate/lead-generation schemes that require selling or sharing consumer opt-in data).

I may refuse, rate-limit, or terminate access for abuse, security risk, non-payment of underlying platform costs, or legal/carrier compliance reasons.

6. AI-generated content disclaimer

Hermes responses may be produced or assisted by artificial intelligence. Content can be inaccurate, incomplete, or outdated. You are responsible for how you use Program responses. Do not rely on Hermes for decisions that require professional judgment or that could cause harm if wrong.

7. Privacy

Handling of personal information, including mobile numbers and message content, is described in the Privacy Policy. That policy includes the commitment that mobile information and messaging consent are not shared with third parties or affiliates for marketing or promotional purposes.

8. Intellectual property

The Hermes name, Program materials, and related branding remain the property of their respective owners. You retain rights in the content you submit by SMS, and you grant me a limited license to process that content solely to operate and improve the Program.

9. Disclaimer of warranties

THE PROGRAM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, I DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. I DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE SERVICE, OR THAT MESSAGES WILL ALWAYS BE DELIVERED BY CARRIERS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE PROGRAM. TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PROGRAM WILL NOT EXCEED USD $50.

11. Indemnity

You agree to indemnify and hold harmless the Operator from claims arising out of your misuse of the Program, your content, or your violation of these Terms or applicable law.

12. Suspension and termination

You may stop using the Program at any time by replying STOP and discontinuing messages. I may suspend or end the Program or your access to it at any time, including for maintenance, abuse, legal reasons, or discontinuation of the service.

13. Changes

I may update these Terms by posting a revised version at https://legal.cadenceworks.tech/terms. The “Last updated” date will change when revisions are posted. Continued use of the Program after changes become effective constitutes acceptance of the updated Terms, except where additional consent is required by law or carrier rules.

14. Governing law

These Terms are governed by the laws of the State of Maine, USA, without regard to conflict of law rules, unless mandatory consumer protections in your place of residence provide otherwise.
