This Privacy Policy describes how Tyler Hudson (“Operator,” “I,” “me,” or “my”), a sole proprietor doing business in connection with the Hermes SMS assistant hosted on Cadence Works infrastructure, collects, uses, and protects information when you interact with the Hermes SMS messaging program (the “Program”) via the Twilio number +1 (207) 230-6594.
1. Who this policy covers
This policy applies to people who text the Program phone number, receive replies from the Program, or otherwise provide mobile contact information in order to use Hermes over SMS. It is specific to the Hermes SMS messaging program and does not replace policies for other Cadence Works products or websites unless those surfaces expressly link here.
2. Information I collect
Depending on how you use the Program, I may process:
- Mobile identifiers: your phone number in E.164 format and carrier routing metadata needed to deliver SMS.
- Messaging content: the texts you send to Hermes and the replies Hermes sends back.
- Consent / preference records: evidence that you initiated contact, opt-out (STOP) and help (HELP) requests, and timestamps of those events.
- Technical delivery data: message status (sent, delivered, failed), error codes from the messaging provider, and basic server logs needed to operate and secure the service.
- Allowlist configuration: if the Program is restricted to approved numbers, the list of permitted phone numbers configured by the Operator.
I do not require you to create an account or submit government ID to text Hermes. I do not intentionally collect precise GPS location through SMS.
3. How I use information
I use Program information only to:
- Receive your inbound messages and send conversational replies from the Hermes assistant;
- Authenticate and authorize use of the Program (including allowlisting, where enabled);
- Honor opt-out, help, and support requests;
- Maintain security, prevent abuse/fraud, troubleshoot delivery issues, and keep service logs;
- Comply with law, carrier rules, and Twilio A2P 10DLC / messaging requirements;
- Improve reliability and safety of the assistant for Program users.
Message frequency varies based on your use. When you text the Program, you typically receive a reply to that message. Message and data rates may apply according to your wireless plan.
4. Legal bases / consent for SMS
The Program is an opt-in messaging service. You consent to receive SMS from Hermes by affirmatively texting the Program number from your own mobile device (or by another clear written consent method the Operator may document). You can withdraw consent at any time by replying STOP. Reply HELP for help.
5. Sharing of information
I may disclose information only as follows:
- Service providers (processors): infrastructure and messaging vendors that help operate the Program (for example, Twilio for SMS delivery, and hosting providers for Cadence Works). These parties process data on my behalf to deliver the service and are not authorized to use your mobile number or messaging consent for their own marketing.
- Legal / safety: when reasonably necessary to comply with law, lawful requests, carrier compliance, or to protect rights, safety, and integrity of the Program and its users.
- Business transfer: if the Program’s operations are transferred, information may move with them under continued confidentiality commitments.
I do not share, sell, or provide mobile phone numbers or messaging consent data to third parties or affiliates for marketing or promotional purposes.
6. Retention
I retain message logs, session records, and delivery metadata for as long as needed to operate the Program, provide continuity of conversations, meet security and debugging needs, and satisfy legal or carrier obligations. Opt-out records are retained as needed to ensure I do not message you after you unsubscribe. You may request deletion of retained conversation content subject to legal and operational limits by contacting me using the details below.
7. Security
I use reasonable administrative, technical, and physical safeguards appropriate to a sole-proprietor messaging service, including access controls on the host systems that run Hermes and encrypted transport for webhook and API traffic where supported. No method of transmission or storage is 100% secure.
8. Your choices and rights
- Opt out of SMS: reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT.
- Help: reply HELP or email the contact below.
- Access / correction / deletion: contact me to request access to, correction of, or deletion of personal information I hold about you in connection with the Program, subject to applicable law.
Depending on where you live (including certain U.S. states), you may have additional privacy rights. I will not discriminate against you for exercising rights available under law.
9. Children’s privacy
The Program is not directed to children under 13 (or under 16 where a higher age is required), and I do not knowingly collect personal information from children through SMS. If you believe a child has used the Program, contact me and I will take appropriate steps.
10. International users
The Program is intended for users with U.S. mobile numbers in connection with U.S. A2P 10DLC messaging. If you access the Program from outside the United States, you understand that information may be processed in the United States.
11. Changes
I may update this Privacy Policy from time to time. The “Last updated” date at the top will change when revisions are posted at https://legal.cadenceworks.tech/privacy. Material changes affecting SMS consent practices will be handled in a manner consistent with carrier and platform requirements.
